Terms and Conditions
ForInteX is an internet services web portal designed to be at the same time a real crossroads for connecting Freelance Engineers, Companies and a valuable business tool that is closest to their needs.
In order to access the services of ForInteX, Companies and Freelancers will have to create their accounts. Any account holder becomes de facto member of ForInteX. To create an active account on ForInteX and therefore access the contents and services of the platform, you must accept these Terms and Conditions.
In order to have an account and be member of ForInteX, Companies and Freelancers must first read and accept an ethical charter.
1. OBJECT
These General Conditions of Sale list the rights and obligations in force for the use of the services of ForInteX, in particular the rights and obligations of members who have created an account on ForInteX.
Are qualified as Members in these Terms and Conditions, all natural or legal persons who have an account, active or inactive, on ForInteX and having, therefore, accepted these conditions.
2. GENERAL CONDITIONS
2.1 Protection of personal information provided by members
All information provided by members when they create their ForInteX usage accounts is an information file that will allow ForInteX to connect Businesses and Freelancers.
By creating a ForInteX account and accepting these General Terms and Conditions of Sale, the member agrees to ForInteX to create this file and use it as part of the services provided to members.
Members authorize ForInteX to use this file and disseminate the information contained in any transaction to promote the services of ForInteX and to achieve the mission of ForInteX.
ForInteX has declared to the CNIL a DPO under the number 44126 pursuant to the General Data Protection Regulation (GDPR) entered into force on 25 May 2018. Members may therefore request updates of information concerning them in correcting them, completing them, deleting them in case of inaccuracy.
Pursuant to Article 2262 of the French Civil Code, ForInteX will archive for a period of time that it deems useful all the information provided by its active or inactive members for open or deleted accounts.
2.2 Constraints related to the use of ForInteX services
The nature of the services offered by ForInteX could be modified by the latter without notice to its members.
The member declares to be perfectly aware of the technical constraints related to the use of the Internet and that he can not in any case make ForInteX liable for damages that would be caused to him when using his services.
ForInteX reserves the right to interrupt or suspend its services temporarily or permanently without notice, the member declares to be informed by the signing of these conditions.
ForInteX reserves the right to remove without notice and without compensation of any kind an account that does not comply with these Terms and Conditions or in which the information provided is false, unfounded or fraudulent.
2.3 Duration of the contract binding ForInteX to its members
Upon the member's registration, the opening of his account on ForInteX and the acceptance of the present general conditions of use, the contract between this member and ForInteX comes into effect and that for an indefinite duration, its termination can be done by one of the two contractors without any notice. To unsubscribe and cancel your contract, simply send an email to our sales department via our contact form.
2.4 Non-transferability of this contract
This contract is personal and commits the member not to assign the rights and obligations relating to the use of his ForInteX account.
2.5 Payment system
ForInteX accepts payment by credit card and bank transfers for the settlement of its services. For the sake of simplification, your subscription is automatically renewed at the end of the term. Messages will be sent to you several days before the expiry of a subscription so that it can be renewed serenely.
2.6 Dispute Resolution
Any claim made to ForInteX will be communicated to the parties concerned, it will be up to them to manage the litigation subject of this claim with diligence.
ForInteX reserves the right to appeal to the competent authorities to settle any dispute that has not been resolved by conciliation.
2.7 Exclusions of guarantees
ForInteX does not guarantee:
• the services rendered will accurately meet the expectations of its members,
• the result obtained by the use of its services,
• the accuracy of the information circulating on its site which is deposited by its members in declarative mode.
2.8 Member Commitments
Each member of ForInteX is solely responsible for the use of his account. This use must comply with the legislation in force, it agrees not to use his account to broadcast any message or information:
• pornographic or pedophile,
• inciting to committing a crime, crime or act of terrorism or advocating war crimes or crimes against humanity,
• encouraging suicide,
• allowing third parties to obtain, directly or indirectly, pirated software, serial numbers of software, software that allows hacking and intrusion into computer and telecommunications systems, or any other attack by electronic means,
• to impair the rights of others and the safety of persons and property,
• in violation of the private nature of the correspondence,
• in violation of the rights of personality,
• in violation of trademark rights,
• in violation of copyrights, etc.
• disrespectful to members of the ForInteX community or to any other person.
The member also agrees to provide accurate information when registering for ForInteX, the latter thus disclaims any responsibility for the inaccuracy of the information provided by these members.
The ForInteX member undertakes not to communicate, outside the fields provided for this purpose, any means allowing the other ForInteX members to contact him directly or to identify him (Website, blog, telephone number , e-mail etc ....). ForInteX teams have the right to delete this information or to exclude the member concerned.
ForInteX members are committed to respecting the editorial line of the ForInteX portal for the engineering professions. ForInteX teams have the right to delete content and exclude members who do not respect this editorial line.
Members registered as Freelance or Enterprise are committed to using their ForInteX account on their own, so they should not share their login information, including passwords, with others. Similarly, registered members may share their ForInteX ID between multiple users, but in no way disclose their login information outside of their Company. Companies, members of ForInteX undertake to consult the CVs only in the context of their personal and exclusive use, in order to fulfill their own missions or those for which they are mandated.
The use of ForInteX by directories sites, databases, web portal services for Businesses and / or Freelance Engineers is expressly prohibited and will result in the deletion of incriminated accounts without refund of sums paid. Any fraudulent use of the information held by ForInteX, in particular to feed any files and databases, also exposes the member who is at the origin to criminal prosecution.
2.9 Price
Each member of ForInteX agrees to know and accepts that the rates vary according to the size of the company and the place of domiciliation for the Companies and according to the geographical location, as indicated on the platform, for the Freelance Engineers. Freelance companies and engineers in emerging and developing countries benefit from adapted tariffs.
